1. Scope

This policy explains how ClaimWrit (a d/b/a of Envisage Companies, LLC) collects, uses, and protects your information when you visit ClaimWrit.com or use the secure Client Upload Portal. It complies with the Florida Information Protection Act (FIPA) and applicable federal law. ClaimWrit is not a law firm, and use of its services does not create an attorney–client relationship.

2. Information We Collect

  • Personal Identifiers: Name, email, phone number, firm name

  • Client Materials: Medical records, bills, accident reports, photos, etc. (may include PHI)

  • Technical Data: IP address, browser type, usage logs via essential cookies and Cloudflare analytics

3. How We Use Your Information

  • Draft demand letters and settlement summaries

  • Create/manage secure folders

  • Communicate about your project and issue invoices

  • Maintain internal records for compliance
    Note: ClaimWrit does not sell or rent your information

4. HIPAA-Aligned Safeguards

  • TLS 1.2+ for data in transit

  • AES-256 encryption at rest

  • Role-based access controls

  • Access logs and quarterly audits

5. Data Retention

Client Materials are retained for 3 years after final delivery unless instructed otherwise. After that, they are permanently deleted.

6. Cookies & Tracking

Only essential session cookies and Cloudflare analytics are used. You can disable non-essential cookies without affecting functionality.

7. Sharing & Disclosure

  • No sale or marketing use

  • Service providers under confidentiality agreements

  • Legal obligations only when required by law or with written consent

8. Breach Notification

If unencrypted personal data is breached, ClaimWrit will notify affected Florida residents within 30 days, and the Florida Attorney General if 500+ residents are affected.

9. Your Rights

  • Request copies or deletion of stored materials

  • Update contact info

  • Withdraw consent (may limit service delivery)

10. Children’s Privacy

ClaimWrit does not knowingly collect data from children under 13. If you upload information about a minor, you confirm you have legal authority to do so.

11. Changes to This Policy

Material updates will be posted on this page and emailed to active clients. Continued use after updates implies acceptance.
